Examples of Real Rights

A real right is a legal power that a person practices over anything. The exercise of this power can be direct and immediate or indirect and mediate. In addition, it is a right that is not linked to third parties.

The basic real rights are property, usufruct, easement, mortgage, pledge, antichresis, emphytheusis and the census. The possession of each of these may or may not be a real right according to the legal system of the country in question.

The civil code of each country establishes each of the types of these real rights, their regulation (if any) and any aspect related to this legal power.

  • Real right of enjoyment.
  • Personal rights proper.
